The Global Talent Stream (GTS) is a fast-track immigration option offered by the Canadian government to help companies access highly skilled foreign talent. Managed by Employment and Social Development Canada (ESDC), this program is divided into two categories—Category A and Category B—each with its specific eligibility requirements. In this post, we’ll walk you through the full program requirements to ensure you’re well-prepared to hire global talent this year.
Eligibility Requirements for the Global Talent Stream
To participate in the GTS, employers must meet several requirements based on the stream they are applying under:
Category A: Employers must be referred by one of the designated referral partners (as of July 2024) and need to demonstrate a unique need for specialized talent.
Category B: Employers must be hiring for roles listed under the Global Talent Occupations List (updated December 2024). These roles are in high demand and require specialized skills.
Processing Fee
A non-refundable processing fee of CAD 1,000 per position is required for every application submitted under the GTS. This fee must be paid by the employer, and it cannot be passed on to the foreign worker.
Recruitment Fees
Employers are prohibited from charging workers any recruitment fees. Any costs associated with hiring, such as recruitment services, must be fully covered by the employer.
Third-Party Representatives and Recruiters
If employers use third-party representatives or recruiters, they must ensure that these parties are in compliance with Canadian laws and regulations. Unauthorized representatives or those who charge the worker for services may lead to penalties and suspension from the program.
New Employers
If you’re a first-time employer applying for the Global Talent Stream, you will need to demonstrate business legitimacy. This involves providing documents such as business licenses, financial statements, and other evidence showing that your business is actively engaged in a legitimate commercial activity.
Business Legitimacy
ESDC requires all participating employers to prove their legitimacy by submitting various documentation. This ensures that the employer is financially stable, offers genuine employment, and complies with Canadian labor laws.
Labour Market Benefits Plan
As part of the Global Talent Stream application, employers must submit a Labour Market Benefits Plan (LMBP). This plan outlines the positive benefits your company will bring to the Canadian labor market by hiring foreign talent. Common benefits include skills training for Canadian employees or job creation in high-growth industries.
Recruitment and Advertisement
Although employers under the GTS are not required to conduct lengthy recruitment efforts within Canada before hiring foreign workers, they must still demonstrate a commitment to hiring Canadians. This may involve showing previous recruitment efforts or strategies for long-term Canadian hiring.
Wages
Employers must offer competitive wages to attract top global talent. According to GTS requirements, the offered salary must meet or exceed the median wage for the occupation in the region where the job is based. This helps ensure that foreign workers are not exploited and are offered fair compensation.
Job Duties and Working Conditions
Employers must clearly define the job duties and ensure that working conditions meet Canadian labor standards. This includes providing details on responsibilities, work hours, and expectations for the role.
Health Insurance
Employers are required to provide foreign workers with health insurance until they become eligible for provincial or territorial health coverage.
Workplace Safety
The workplace must comply with all Canadian workplace safety regulations to ensure the safety and well-being of the employee. The employer must provide training, personal protective equipment, and resources to maintain a safe work environment.
Employment Agreement
A written employment agreement must be provided, outlining all terms and conditions of employment, including salary, job duties, and any benefits. This agreement helps protect both the employer and the foreign worker, ensuring clarity and compliance with Canadian labor laws.
Language of Work
The language of work must be English or French unless another language is essential for the role. Employers must clearly state the required language skills in the job offer.
Unionized Positions
If the position is unionized, employers must provide proof that the foreign worker will be treated in accordance with the collective agreement. The terms of employment for unionized positions must align with union rules and standards.
Employer Compliance
Participating employers must comply with all GTS regulations, including those related to wages, working conditions, and employment standards. Failure to comply may result in penalties or suspension from the program.
